Prop. 8 Gay Marriage Battle Heats Up

The California Supreme Court heard arguments today challenging Proposition 8, the constitutional amendment approved by voters in November that declares marriage to be between one man and one woman.

The Gay Community, who seek the Supreme Court’s legalization of homosexual marriage, went down the streets in November outraged that the people of California decided twice to define that marriage is between one man and one woman, and this last time they amended the state constitution.

After Prop. 8 was approved by voters, lawsuits were immediately filed by gay activists, and some local governments, seeking to have the measure struck down. One key point of contention is whether Prop. 8 was a valid amendment to the state constitution, as opposed to a revision, which would require more procedural hurdles, such as approval by the state legislature. In the past, some measures have been deemed revisions when they imposed radical structural changes to state government.

Today’s just-concluded oral arguments at the California Supreme Court over the validity of Prop. 8 were marked by lively exchanges between attorneys and the justices.  READ FULL ARTICLE
