Judge Sends Pro-life Pastor Walter Hoye to Jail

Today, March 20, 2009, Pro-life Pastor Walter Hoye of Berkeley, California, was ordered to serve 30 days in county jail by Judge Stuart Hing of the Alameda Superior Court.

Hoye had been found guilty on January 15, 2009, of unlawfully approaching two persons entering an abortion clinic in Oakland. Judge Hing had also ordered him to stay one hundred yards away from the abortion clinic for three years. However, Walter Hoye refused this term of probation and would not agree to a stay-away order. Therefore, the judge denied the defense motion to stay the sentence pending appeal. Hoye was taken into custody from the courtroom.

At a hearing on February 19, Judge Hing stated that he had not intended to impose any fine or jail time on Hoye if he would agree to stay away from the abortion clinic. After Hoye refused to agree not to offer alternatives to abortion-minded women, Judge Hing imposed a 30-day sentence and $1130 fine.

Dozens in the African-American and pro-life communities from around the nation who came out in support of Pastor Hoye were outraged by the sentence. The consensus of these leaders is that it was a travesty that Pastor Hoye was found guilty in the first place for standing in the gap for black children targeted by the abortion industry.

"It is absolutely incredible that in America an individual can be sentenced to jail for engaging in peaceful free speech activity on a public sidewalk," remarked Allison Aranda, Staff Counsel for Life Legal Defense Foundation. Aranda further stated, "Rev. Hoye is being singled out for particularly harsh punishment because he refused to agree not to offer help to women considering abortion. Where is the justice in that?"

Hoye is an African-American pastor who feels a special calling to work for the end of the genocide-by-abortion taking place in the African-American community. As part of his efforts, he stands in front of an abortion clinic in Oakland with leaflets offering abortion alternatives and a sign reading, "Jesus loves you and your baby. Let us help." In response, the Oakland City Council passed an ordinance making it a crime to approach persons entering abortion clinics to offer alternatives to abortion. Approaching women to encourage them to enter the clinic is permitted, according to City policy.

According to 2004 statistics from the National Center for Health Statistics, about 37 percent of pregnancies of black women end in abortion, compared with 12 percent for non-Hispanic white women and 19 percent for Hispanic women.

LLDF Legal Director Catherine Short and attorney Mike Millen, who also represented Rev. Hoye at trial, are currently challenging the constitutionality of the ordinance on Hoye's behalf in federal court. They are hopeful the ordinance will be struck down and Pastor Walter Hoye vindicated.

Send Judges to Jail

Time to send some judges to jail. This is what happens when totalitarianism in defense of child-killing is the law of the land. Those who seek social justice do prison time, while the baby butchers in abortion clinics and the judges/politicians who defend them walk free. Time for another civil rights movement on behalf of the most persecuted people group in the U.S., the preborn. God bless America? I think its evident what God thinks of America. Just read the financial pages these days.

He was sent to jail because he was pro-life. He was sent to jail because he broke the law.

The pastor blatantly defied a court order.

What did you all expect?

You can't blatantly break the law and expect to not be punished.

Pastor Hoye obeyed God's command to love your neighbor as yourself, for this "crime" he is being punished. He has brought the humanity of the preborn to the fore front. With so many "pastors" sitting on the sidelines, he's a breath of fresh air. May Pastor Hoye's ministry continue while he's incarcerated. The Word of God can never be bound! Praise the Lord!

The Ugly Truth

Law? There is no law in this country for the most vulnerable of all; our own innocent babies. America is the seat of lawlessness; a moral and spiritual desert.

If you think what this pastor did is breaking the law, how does government sanctioned genocide strike you? Consider these facts:

UNITED STATES

Number of abortions per year: 1.37 Million (1996)
Number of abortions per day: Approximately 3,700

Who's having abortions (age)?
52% of women obtaining abortions in the U.S. are younger than 25: Women aged 20-24 obtain 32% of all abortions; Teenagers obtain 20% and girls under 15 account for 1.2%.

Abortion is premeditated murder brought about by the so called sexual revolution, the feminist movement and became constitutional law with ROE vs WADE. We are barbarians to allow this practice to continue.

I pray for more people like this pastor who will stand up and at least offer women an alternative (of which there are many) to this insanity.

CONSTITUTION

Where is the constitutionality of this law that the city council passed? Every person is guaranteed the RIGHT to free speech and to PEACEFULLY assemble and protest. This can't hold up. Can he appeal? This isn't communist china afterall, though planned parenthood and their bloody ilk would like it to be.

And Dave, yes the pastor defied a court order...a court order which violated his 1st amendment right to free speech.

My comment is short. Our forfathers fought this kind of tyrany against the British empire. Patrick Henry said " Give me liberty or give me death". These men laid down their names and their lives for freedom. Are we willing to do the same for those who don't have a voice. Jesus said " you will be hated by men for my name's sake".

Thanks Pastor for standing for truth. Like many others including Daniel and Shadrach, Meshach and Abednego - who all refused to conform to laws that violated God's Law - we cannot turn a blind eye to babies being murdered despite what the law says.

Praise God. Let us rejoice in our sufferings for His sake.

Walter broke no laws

Walter didn't break any law. He respected the ordinance and stood at 100 feet. He also never approached any woman without her invitation, which is also obeying the law. He was convicted on a misdemeanor of "intent" to break the law, but there was clear evidence that he had NEVER broken the law, while enduring constant harassment from the clinic. Now that corrupt judge (who apparently let a MURDERER off with a $200 FINE!), against the advice even of his D.A., has imposed a probation including a penalty NOT SPECIFIED as a consequence in the ordinance - which was to push Walter back 100 YARDS, not 100 feet as set by the ordinance. The judge has no authority to do this, and he has no authority to do anything but to put Walter in jail, eligible for bail - but he would not. A higher court will show Stuart Hing to be the utterly corrupt incompetent that he really is. And Dave, the judge's comments at the final sentencing made it abundantly clear that the judge was discriminating against Walter's pro-life views.

I can not get over this! Women can legally be approached, to get an abortion, but it is un-lawful to approach a woman to offer an alternative? This reminds me of a car I saw once that had one bumper sticker that said save the whales and another one that said pro-choice. (Save the mamals, kill the babies)!! And this kind of thinking is now running our country. Sad isn't it? And to Dave--Just because the law says, abortion is legal, does not make the law correct. I am proud of this man for standing for what he believes in!

The Thoughts of the Unborn

Pain is so real and it's easy to see
It all happens to you and me

I know we are born to die
But at such a young age I don't understand why

I was so young and didn't understand
God would allow a change that I had not planned

I had no control over when I would go
But this I know I love you so

I live in your heart I am happy to say
Always there no matter what you think or pray

I love you and want you to love me
That's the way it should be

You weren't perfect I know quite well
God gave us each other I am happy to tell

Our hearts are melted together and its easy to see why
Our love will never die

For you are special to me
And always will be

Thank God for giving to me
An opportunity for life you see

Mom and dad please don't be too sad
You can learn from your mistakes for which I am glad

And if another child should come your way
Do what is right is all I can say

You didn't steal eternity from me
For I am a creation of God you see

No one is righteous before our dear Savior
Our thoughts are wrong including our behavior

Ask God and the person you mated with to forgive you
Forgive yourself and live the abundant life.
